Legal matters we handle for clients abroad
A lawyer for overseas Pakistanis can explain the Pakistan-side process, prepare documents and represent you when instructed. These overseas Pakistani legal services cover property, succession, family, criminal and document matters. The right route depends on the issue, the court or office involved, and whether its rules allow an attorney to act for you.
Property disputes and illegal possession (qabza)
When a lawyer for overseas Pakistanis in Lahore reviews a property matter, we start with the title and land record, the people involved and any proceedings already under way. We check the registry, transfer or allotment papers, fard, proof of identity and residence abroad, and dated evidence of occupation.
The Punjab Establishment of Special Courts (Overseas Pakistanis Property) Act 2025 applies only in Punjab. A qualifying owner or authorised representative can petition the special court. Counsel handles the Pakistan-side filing, and you provide instructions and evidence. A complaint desk may refer the matter, but it cannot decide title. Power of attorney from abroad
A lawyer for overseas Pakistanis can draft a special power of attorney narrowly for the case, property or act, subject to the receiving office's acceptance. NADRA's digital route requires identity documents for the applicant, attorney and two witnesses, biometrics, a scanned draft, online payment and a mission video interview.
Manual consular attestation also remains available, with requirements varying by mission. Under MOFA's process, the mission attests the POA and MOFA verifies it in Pakistan; the attorney attends with original CNIC. Check your mission's live checklist before booking. Inheritance and succession from abroad
NADRA can issue a Succession Certificate for movable assets and a Letter of Administration for immovable property under the Letters of Administration and Succession Certificates Act 2020. Its succession guidance says one legal heir must apply in person at a designated site in Pakistan.
Counsel can check the death certificate, family registration certificate, list of heirs and asset details. Other heirs may verify biometrics at a Pakistani mission where offered. An objection or dispute can move the matter to court. See the overseas inheritance guide.
Divorce and talaq from abroad
A talaq pronounced under the Muslim Family Laws Ordinance 1961 requires written notice to the relevant Union Council Chairman and a copy to the wife. The correct council depends on where the wife lived when talaq was pronounced, with fallback rules if she was not living in Pakistan. We can check the council and prepare the notice; you provide the required instructions and records.
Since January 2026, NADRA has accepted divorce-certificate applications through its PakID app in all Punjab districts, at the time of writing; the certificate records the Union Council or court outcome and does not replace it.

Khula when the wife lives abroad
Khula is a Family Court suit under section 10(4) of the Family Courts Act 1964. Counsel can file under a special POA, though the court may still require the wife's own evidence.
Since November 2025, an LHC video-link facility has been available for district courts across Punjab. An overseas litigant may seek to join through a Pakistan mission or authorised notary, subject to an advance request and court approval. A video link does not make the case fully remote. Child custody and guardianship
Child custody is decided by the Guardian Court under the Guardians and Wards Act 1890, with the child's welfare as the deciding consideration. A custody order is not, by itself, permission for a child to travel.
If parents are separated or divorced, passport requirements include custody papers and the other parent's consent on attested stamp paper, or that parent's attendance. Documents: MOFA attestation, NADRA marriage and divorce records
Document work for overseas Pakistanis often starts with the attestation chain. Documents issued in Pakistan may need prescribed attestation before use abroad. Documents made abroad may need authentication by the issuing country's foreign ministry and the Pakistan mission.
For a Pakistani marriage involving a foreign spouse, MOFA's process calls for the original Nikah Nama and MRC, plus the foreign spouse's passport, Pakistan visa and date of entry. A NADRA divorce certificate records an underlying Union Council or court outcome; it does not replace it. Read the MOFA attestation guide and the NADRA marriage certificate guide.
Criminal cases: FIRs, bail and travel restrictions
A person abroad can instruct a Lahore lawyer about an FIR, bail application, criminal defence or a travel restriction affecting Pakistan. The file needs to be checked against police and court records, and an attorney cannot replace steps the court requires from the accused personally.
Cybercrime complaints go to the National Cyber Crime Investigation Agency (NCCIA), which asks an overseas complainant to nominate a Pakistan-based focal person. Tax notices and property tax as a non-resident
A non-resident dealing with a Pakistani tax notice or property transaction should check how residence, documents and the transaction date affect the position. An eligible NICOP or POC holder who is non-resident, meaning under 183 days in Pakistan in the tax year, may ask FBR for filer rates on property withholding under sections 236C and 236K. The request uses a PSID and requires Commissioner approval. Rates change, so confirm the current position with FBR or a tax adviser before acting. See our tax lawyer in Lahore page.

How a matter runs while you stay abroad
We review the documents, identify the right authority and agree who will handle each step. You provide instructions and evidence; counsel or an authorised representative handles Pakistan-side work.
In our experience, overseas matters most often stall on four things: spelling or number differences between the CNIC or NICOP, passport, nikah nama and property papers; a POA that does not name the specific case, property or act; a POA missing its mission attestation or MOFA verification; and an attorney in Pakistan who cannot attend when an office asks for them. - Consultation and review: Explain the issue, what has happened so far and what you want to achieve. Share scans through an agreed channel.
- Check originals and evidence: Keep original identity, property, family or court documents available. Send them only when a court or office requires them.
- Choose the right authority: Confirm whether the matter belongs in court, a Union Council, NADRA, a land-record centre or an administrative channel.
- Prepare a narrow power of attorney if needed: Match its authority to the task and follow the mission's checklist or NADRA's digital process. Confirm acceptance with the receiving office.
- File and attend in Lahore: Counsel or your attorney handles authorised filings and office visits. The lawyer checks court listings and explains the next step after hearings.
- Plan required personal steps: Arrange any required evidence, biometrics or attendance. Ask the court about a video request early.
Official channels for overseas Pakistanis, and where a lawyer fits
Complaint and facilitation channels can direct a problem to the right department, but they do not decide every legal issue. A lawyer can advise whether to use a complaint process, file in court or take another administrative step, then prepare the papers for that route.
Punjab Special Courts for overseas property
The Punjab Establishment of Special Courts (Overseas Pakistanis Property) Act 2025 is Act IX of 2025 and applies only in Punjab. An overseas Pakistani or authorised representative may petition the special court. Section 9 sets a 90-day statutory target from the grant of leave to defend. It does not promise disposal within 90 days. The Act authorises electronic procedure rules and video participation on request, subject to the court's process.
A May 2026 Lahore High Court ruling was reported by Dawn as covering property-linked disputes including inheritance, partition, mutation and contracts. Check the judgment and local filing position in each case. This court route is separate from another provincial law whose status remains before the courts.
LHC Overseas Pakistanis Cell
The Lahore High Court Overseas Pakistanis Cell accepts complaints about illegal possession, purchase fraud, litigation delay and difficulty pursuing a case from abroad. It can route or facilitate a complaint, while the proper court handles the case itself. The LHC Overseas Pakistanis Cell lists its complaint channels.
Punjab Overseas Pakistanis Commission
The overseas pakistanis commission punjab accepts online complaints from abroad, screens them and may refer them to a department or District Overseas Pakistanis Committee. It can offer administrative redress or make a referral; ownership disputes still need a court decision. The Punjab OPC portal accepts complaints online.
OPF complaint system
The OPF complaint system coordinates with Punjab OPC on encroachment matters. Ownership disputes and other court proceedings must go through the courts.
PKM Global police documents
Punjab Police's PKM Global service is available through Pakistani missions in 40+ countries for character certificates, FIR copies and other police documents. For a Lahore matter, counsel can review the FIR or police record and explain the next court step. You provide the papers and instructions. NCCIA for cybercrime
Cybercrime complaints are handled by the National Cyber Crime Investigation Agency, not the former FIA Cyber Crime Wing. An overseas complainant should nominate a Pakistan-based focal person under NCCIA's guidance. Counsel can review the complaint and relevant record; the client provides the evidence and identifies the focal person.
Documents to keep ready
Keep readable scans of your identity and residence documents, along with records for the matter. Requirements depend on the legal route, so use this list to prepare, then check what the relevant office needs.
- Passport and CNIC, NICOP or POC, plus proof of residence abroad if the Punjab Special Courts definition may apply. That definition covers a qualifying identity holder who lives, works or studies abroad for more than 182 days in a tax year.
- Property documents and correspondence, such as the available ownership, transfer, allotment or land-record papers. Keep any notices, objections or earlier court orders together.
- For a family matter, the Nikah Nama, MRC, Union Council correspondence, court papers and any existing custody order that relates to the issue.
- For inheritance, the deceased person's records and available family or asset documents. NADRA or the relevant court can confirm what is required for the application.
- For a criminal matter, the FIR number or copy, notices, bail papers, court orders and relevant police correspondence.
- For a POA, check the mission's current list for the applicant, attorney and witnesses, the draft authority and any identity or biometric steps. Requirements vary by mission.
If you live in the UK, the Gulf or North America
The legal route is broadly similar across these regions. Pakistani mission checklists and the destination country's recognition rules vary, so confirm the requirements before signing or sending originals.
UK
Check your Pakistani mission's current instructions for consular POA attestation, or use NADRA's digital POA route. UK recognition of a Pakistani divorce depends on how it was obtained and the connection tests under UK law. Get UK advice before relying on a Pakistani record there. Gulf
For a document issued in Pakistan and intended for use in the UAE, Pakistan MOFA attestation comes first. The UAE's digital service then covers UAE Embassy and UAE MOFA attestation through UAE Pass, and requires the original physical document. Other Gulf states have their own receiving requirements, so check the local Pakistani mission and the Pakistan office involved. US and Canada
Pakistani mission POA procedures vary, so check the current instructions for your US or Canadian location. Manual consular attestation remains available alongside NADRA's digital POA process. For an apostilled POA, ask the receiving registrar or society whether it accepts an apostille for the specific transaction. An apostille authenticates a signature or seal, not the contents of the document, and MOFA's POA-specific process still describes mission attestation followed by verification in Pakistan. Confirm the route with both your mission and the receiving authority before signing.

Often. You can consult remotely, share scans and instruct counsel for Pakistan-side work. A special power of attorney may allow a representative to act if accepted by the relevant authority. The lawyer can identify any steps that need your own biometrics, evidence or attendance.
Do I need a power of attorney?
Not for every task. A special POA authorises someone in Pakistan to take defined steps for you, if the receiving authority accepts it. Follow your mission's checklist or NADRA's digital process, then confirm the receiving office's requirements.
Can my case be heard by video link?
You can request a video link in an eligible Punjab property or family matter. The court decides whether to approve it, and the request may need to be made in advance. Approval for a hearing does not make the whole case remote.
Which Pakistani court handles my property dispute?
The Special Courts Act 2025 may cover a qualifying overseas Pakistani's property-linked dispute in Punjab. It does not apply elsewhere, and an administrative commission cannot hear a court case. Have the papers reviewed before choosing where to file.
Can my relative in Pakistan act for me instead?
A relative can act as your representative if the document and receiving authority permit it. Being a family member alone does not authorise them to sign, file or give evidence for you. Confirm the requirements with the court or office.
